International Trademarks Frequently Asked Questions

What is the international trademarks system?

It is known as the Madrid system and was established in 1891. It functions under the Madrid Agreement (1891), and the Madrid Protocol (1989). It is administered by the International Bureau of the World Intellectual Property Organisation (WIPO) located in Geneva, Switzerland.

How does the Madrid Protocol work?

If you are a trademark owner, the Madrid system offers you the possibility of protecting your trademark in several countries that are members of the Madrid protocol by simply filing one application directly with his own national or regional trademark office.

What does this mean for my trademark?

Do you have a UK or EC trade mark, if the answer is NO then you need to apply for a UK or EU trademark. Once you have a filing date you can then use this application in either the UK or EU to apply for registrations for international trademarks throughout the world.

If the answer is YES, then you are immediately eligible to apply for an International trade mark.
