If you are a business trading in Norway or intend to trade in Norway in the future, it is important to register your mark to obtain an exclusive right to it. The protection of trademarks is regional and therefore it is important to register in each individual country.

Although there is no legal requirement for registering your trade mark, it is advantageous to obtain an exclusive right for your trademark as it ensures the protection of your brand.

The process of registering your trade mark consists of 2 stages:

1. Search:

This is a very important stage in the process as it involves us carrying searches to ensure that a similar trademark does not already exist. Our services will include:

  • The gathering information from you about the products and/ or services you trade in. This will enable us recommend the products and/ or services the trademark will be best protected under as well as the appropriate classifications,
  • The conducting a comprehensive search which will identify any similar or identical marks registered in Norway whether national or international and
  • The reporting on the chances of registration.

The report will give details of any marks which may be similar or identical to the mark that you are trying to register, if this is the case we will advise you not to proceed with registration. If you choose to proceed with the registration, it is likely that the mark will be opposed and you may be prosecuted for trade mark infringement.

If the report comes back successful we move onto the next stage.

2. Registration:

To register your trademark in Norway, we will file an application for trademark registration with the Norwegian Industrial Property Office by compiling information about your trademark and filling in the necessary documents and then file the mark.

If your mark is registered, it will be published online at www.patentstyret.no and you are sent a certificate of registration.

A registered trade mark gives the mark a 10 year term protection which can be renewed indefinitely. However if it is shown that you have not used the mark for the products and/or services it is registered under within 5 years your mark may lose its protection.
