©, ® or TM?

The © sign is used where a person recognises that there work has copyright protection, you will generally see this sign in books and at the bottom of webpages, an example is © Trade Mark Room 2009.

It is important to note that the © should not be used in relation to a trade mark, as the © referrers to copyright which is a different form of intellectual property.

The ® should be used when you have a registered trade mark only, it is an offence to use the ® when your mark is not registered.

Where your brand is not registered but you use it as a trade mark then you may affix the TM sign to the right hand corner. Clients usually use the TM when they are going through the process of registration.
