If you have a registered trade mark in the UK or EU you will be notified of any similar applications that are subsequently filed by third parties in the following circumstances;

UK; If you own a UK trade mark application and a third party files a similar UK trade mark application you will be notified by the UK Intellectual Property Office. You will be given 2 months to oppose the application or alternatively, you can file a TM7(a) which extends this period to three months.

EU; (1) If you own an EU trade mark application and a third party files a similar UK trade mark application you will ONLY be notified by the UK Intellectual Property Office if you have opted in. Opting in costs £50.00 and can be done via the UKIPO website.

(2) if you own an EU trade mark application and a third party files a similar EU trade mark application the Office of Harmonisation for the Internal Market (OHIM) will notify you and you will be given three months to oppose the application.
