Lady Gaga was successful last week in her attempts at securing an interim injunction against the Moshi Monster character ‘Lady Goo Goo’ which is owned by UK company Mindy Candy Limited who also owns the children’s social networking site, Moshi Monsters.
Legal proceedings were brought by Lady Gaga's lawyers ( including 11 South Square) when Mindy Candy sought to release a single ‘The Moshi Song’ which seems to mimick her hit song, ‘Bad Romance’.
Mind Candy argued that it could not be possible to confuse the two but the Judge disagreed and found that Candy must be prevented from “promoting, advertising, selling, distributing or otherwise making available to the public The Moshi Dance or any musical work or video that purports to be performed by a character by the name of Lady Goo Goo, or that otherwise uses the name Lady Goo Goo or any variant thereon.”
The good news for Moshi fans is that the Goo Goo character can still be used.
