Trade Marks and registered Company names

We are often asked whether a company’s name registered at Companies House is also protected as a trade mark. Unfortunately, the answer is no.

The name of a Company should not be confused with trade marks – from a legal point of view, they are treated as two separate names. Companies House will accept any company name proposed for registration so long as it is not identical to an existing registered name. On the other hand, trade mark registration is not so straightforward; it involves a more complex registration process. In the UK, the Trade Mark Act 1994 sets out certain requirements before a proposed trade mark can be successfully registered.
